Introduction
These specific terms and conditions (“Service Specific Terms”) apply in relation to the provision of the Service by Etisalat to the Customer, in addition to the other constituent parts of the Agreement between Etisalat and the Customer.
Definitions
a) “Agreement” means the entire contractual agreement between Etisalat and the Customer, comprising of the constituent parts set out in Clause 3 of the General T&Cs (Consumer).
b) “Customer” means the person who purchases or subscribes to the Service.
c) “Etisalat” means Emirates Telecommunications Group Company PJSC.
d) “General T&Cs (Consumer)” means Etisalat’s general terms and conditions for consumer (i.e. non-business) products and services which are published on Etisalat’s website and are available through the other communications channels referred to in Clause 30 of the General T&Cs (Consumer).
e) “Old Smartphone” or “Device” means the eligible smartphone device that the Customer currently owns and wishes to trade it in.
f) “Partner” or “Partners” means the owner of the vending machine, which the Customer uses to facilitate the Service for collecting and accepting Old Smartphone or the service provider approved by Etisalat to visit the premises of the Customer to collect the device.
g) “Partner Machine” means the vending machine operated by the Partner in collaboration with Etisalat to collect and accept old smartphones from Customers based on specific criteria for the provision of the Service.
h) “Service” means Etisalat’s trade-in program for old smartphones devices, which allows Customers to trade-in their owned old smartphones devices, as described in more detail in Clause 3.
i) “Smiles Points” means the points earned by the Customer upon completing a successful trade-in transaction as provided in these Service Specific Terms, which can be utilized by downloading the Smile Etisalat application (the “Smile Application”) to receive various benefits and obtain purchase vouchers.
j) “SMARTPAY” offers instalment plans for device shoppers, allowing customers to pay for their purchases in 12,18 ,24 and 36 recurring monthly instalments.
k) “e&Money” means Etisalats digital wallet and financial services platform for the application, that allows users to conduct various financial transactions via their mobile devices. And this includes features for money transfers, bills payments, mobile top-ups, and online purchases, etc. (hereinafter referred to as “e&Money Account”).
b) “Customer” means the person who purchases or subscribes to the Service.
c) “Etisalat” means Emirates Telecommunications Group Company PJSC.
d) “General T&Cs (Consumer)” means Etisalat’s general terms and conditions for consumer (i.e. non-business) products and services which are published on Etisalat’s website and are available through the other communications channels referred to in Clause 30 of the General T&Cs (Consumer).
e) “Old Smartphone” or “Device” means the eligible smartphone device that the Customer currently owns and wishes to trade it in.
f) “Partner” or “Partners” means the owner of the vending machine, which the Customer uses to facilitate the Service for collecting and accepting Old Smartphone or the service provider approved by Etisalat to visit the premises of the Customer to collect the device.
g) “Partner Machine” means the vending machine operated by the Partner in collaboration with Etisalat to collect and accept old smartphones from Customers based on specific criteria for the provision of the Service.
h) “Service” means Etisalat’s trade-in program for old smartphones devices, which allows Customers to trade-in their owned old smartphones devices, as described in more detail in Clause 3.

And this includes features for money transfers, bills payments, mobile top-ups, and online purchases, etc. (hereinafter referred to as “e&Money Account”).
Service Description
Etisalat Old Smartphones Devices Trade-in Program, is a program or service provided by Etisalat, that allows current or new customers or customers from other networks to easily trade-in their Old Smartphones, and receive points equivalent to a credit value in their Smiles Points account or trade in wallet via valid and activated e&Money account, which can be redeemed at any of Etisalat’s branches, in accordance with the terms of this Agreement.
If the customer opts to receive the payment through e&money account and the money cannot be successfully deposited into the customers e&money account, the value will be automatically transferred to the Customers Smiles Application account. If the Customer does not have a Smiles Application account, a new Smiles Application account will be created for the Customer automatically.
If the customer opts to receive the payment through e&money account and the money cannot be successfully deposited into the customers e&money account, the value will be automatically transferred to the Customers Smiles Application account. If the Customer does not have a Smiles Application account, a new Smiles Application account will be created for the Customer automatically.
Commencement & Duration
a) The Agreement is valid and binding on and from the date on which it is submitted to and accepted by Etisalat (the “Effective Date”).
The term of this Agreement (the “Term”) commences on the date on which Etisalat makes the Service (all or part thereof) available to the Customer (“Activation Date”) and shall remain in effect until one of the following events occurs, whichever is earlier:
1. The Customer fully receives Smiles Points or receives the amount of money to the e&money account, which amount is equivalent to the Old Smartphone’s value through this Service; or
2. Termination by either party, as described in Clause (9) below.
The term of this Agreement (the “Term”) commences on the date on which Etisalat makes the Service (all or part thereof) available to the Customer (“Activation Date”) and shall remain in effect until one of the following events occurs, whichever is earlier:
1. The Customer fully receives Smiles Points or receives the amount of money to the e&money account, which amount is equivalent to the Old Smartphone’s value through this Service; or
2. Termination by either party, as described in Clause (9) below.
Customer Obligations & Restrictions
a) The Customer shall be at least 18 years old and has the legal capacity to enter into this Agreement and abide by the Service Specific Terms. Etisalat bears no responsibility or liability for any damage or claim resulting from the Customer breach to these Service Specific Terms. Etisalat reserves the right to suspend or restrict the Customer use of the Service.
b) The Customer shall be solely responsible for deleting all data from the Old Smartphone, this includes account data, personal and confidential information, photos, videos, passwords and locks. The Customer must also remove Google, iCloud, and any other cloud backups from the Old Smartphone, and perform a factory reset on it, before completing the Service registration process.
c) The Customer shall be solely responsible to back-up and save any files, images, personal information or any other data from the Old Smartphone before completing the Service registration process. Further, the Customer acknowledges and agrees that neither Etisalat nor its Partner shall, under no circumstances, be held responsible or liable for:
1. any direct or indirect loss or damage arising from the use of Customer personal information that remains on the Device, and which the Customer failed to remove.
2. any loss of data, content, or disclosure of files which has not been removed from the Device when it was submitted for the Service.
3. any data remains on the Device when the Device ownership is transferred to a third party.
4. Etisalat is not obligated to provide data retention or data recovery services for the Customers personal data in relation to this Service.
d) The Customer shall be responsible for removing the SIM card and memory card, charger, cover, headset and any other accessories from the Old Smartphone. Etisalat shall not be held liable for any costs, losses, or damage resulting from the Customer’s failure to remove these items from the Old Smartphone.
e) The Customer acknowledges that he/she is the owner of the Old Smartphone at the time-of-Service provision.
f) The Customer acknowledges that there is no security or safety software or program on the Old Smartphone that would prevent Etisalat to unlock or access it.
g) Please also see Clause 8 of the General T&Cs (Consumer) for the provisions governing the Customer obligations and restrictions that apply to the Service.

Etisalat’s Obligations
Etisalat will provide the Service to the Customer based on these Service Specific Terms together with the other constituent parts of the Agreement, and in accordance with the law.
Devices Assessment & Service
A. The Device must be a smartphone.
B. The Device model and specifications must be listed in details in the Partner Machine drop-down menu as an eligible Device.
C. The Customer’s Device must not be reported as lost, stolen, or otherwise inaccessible at the time of submission to Etisalat for the use of the Service. Etisalat bears no liability for any claims, damages or losses arising from the Customer’s ownership of lost or stolen Devices or the Customer inability to access the Service for any reason.
D. Etisalat reserves the right, at its sole discretion, to determine any date for the Service provision or cancellation, or modification of these Specific Term and Conditions. Etisalat shall communicate such conditions through the communications channels stated in Clause 30 of the General T&Cs (Consumer).
E. If device is purchased from Etisalat via SmartPay contract, the outstanding amount should be settled fully by the customer at Etisalats business center before the trade-in activity takes place.

Etisalat shall communicate such conditions through the communications channels stated in Clause 30 of the General T&Cs (Consumer).
E. If device is purchased from Etisalat via SmartPay contract, the outstanding amount should be settled fully by the customer at Etisalats business center before the trade-in activity takes place.
Device Eligibility Restrictions
Device will not be accepted if it is purchased under a business instalment plan from Etisalat, and the instalments are not fully paid off.
Service Guidelines & Requirement’s
a) The Customer is required to hand in their old smartphone to the Partner during the home visit or to deposit the smartphone in the machines located in our business centres.
b) Etisalat will evaluate the Old Smartphone eligible for the Service and accept it if it is in a good condition, and will check the accessibility of its International Mobile Equipment Identifier (IMEI), as further described in Clause (d/a).
c) Etisalat in it is sole discretion will determine whether the Old Smartphone is in a good condition or not, and may request the Customer to provide a proof of purchase or additional information about the Old Smartphone.
d) To determine whether an Old Smartphone qualifies as being in a good condition for the Service, Etisalat must ensure that Old Smartphone meets the following conditions:
a. The Old Smartphone can power on, and its associated International Mobile Equipment Identifier (IMEI) number can be accessed by dialing *#06#.
b. The Old Smartphone functions normally, such as making and receiving calls, connecting to the internet, having proper touchscreen functions, hold a charger, and maintaining a consistent battery level without sudden shutdown.
c. The Old Smartphone must be free from material defects and damage, except for what may result from normal wear and tear, this includes, but is not limited to, significant cracks or breaks in the LCD screen; multiple scratches; screen discoloration, black or white spots on the screen, burn-in marks on the screen, indications of water or liquid damage, corrosion of the charging port, damage to the SIM reader, or malfunctioning or swollen battery.
d. All activation and locking features of the Old Smartphone have been disabled (e.g. “find my device” on iOS 7+ devices, pin lock or screen lock, or anti-theft lock, etc.).
e. Upon the successful completion of the registration and evaluation process via the Partner Machine and approval of the Old Smartphone, the Customer will place the Old Smartphone in the specified place within the Partner Machine. The Customer acknowledges that once the Partner Machine takes the Old Smartphone, the Device ownership will transfer to Etisalat/Partner and it cannot be returned under any circumstances.
b) Etisalat will evaluate the Old Smartphone eligible for the Service and accept it if it is in a good condition, and will check the accessibility of its International Mobile Equipment Identifier (IMEI), as further described in Clause (d/a).
c) Etisalat in it is sole discretion will determine whether the Old Smartphone is in a good condition or not, and may request the Customer to provide a proof of purchase or additional information about the Old Smartphone.

Payment
The value of the traded-in device will be credited as Smiles Points or cash deposited into the customers e&Money wallet, providing flexible options for customer.
Device Home collection
Customers have the option to schedule the collection of their devices from their preferred address on a chosen date and time.
Prior to the device collection customer must remove all accessories linked or attached to the device, remove Google, iCloud, and any other cloud backups, and perform a full factory reset and clear all passwords and locks.
Etisalat and its Partners will not responsible nor liable for any personal information or data left on the device.

Suspension, Disconnection or Termination By Etisalat
Please see Clause 19 of the General T&Cs (Consumer) for the provisions governing the suspension, disconnection and termination of the Service or the Agreement by Etisalat

The Customer may contact Etisalat to discuss the Service (including these Service Specific Terms and the General T&Cs (Consumer), or any other product or service offered by Etisalat, by using any of the communications channels stated in Clause 30 of the General T&Cs (Consumer).

Please see Clause 32 of the General T&Cs (Consumer) for the provisions governing VAT Value Added Tax that apply to the Service.
